The decree declaring a nationwide disaster situation due to the El Niño phenomenon, issued by the President of the Republic and the Director of the Administrative Department of the Presidency of the Republic, fails to meet the requirements established by Law 1523 of 2012, as it did not specify essential aspects such as the grounds and criteria constituting the disaster situation, the scope of the special regulatory regime, or the general guidelines for the preparation of the Specific Recovery Plan. Furthermore, the duration of the measure exceeds the technical forecasts.
