The Foundation for the Rule of Law files suit before the Council of State against the decree requiring pension funds to repatriate foreign investments

The Foundation for the Rule of Law filed an annulment action against Decree 369 of 2026, issued by the Ministry of Finance, which imposes a 30% cap on foreign investments by mandatory pension funds and requires that new contributions be invested primarily in Colombia. Currently, a significant portion of the pension savings held within the individual savings regime is invested in international markets, which allows for risk diversification and improved returns.
