Annulment action against Decree 044 of 2024 regulating the temporary mining-environmental reserve

Decree 044 of 2024 created the figure of a temporary natural resource reserve with effects on mining activity. This Decree was issued without legal competence, without sufficient technical basis, and without guaranteeing the effective participation of affected stakeholders, in contravention of the Mining Code, Legislative Decree 2811 of 1974, Law 99 of 1993, and the participatory procedure required by Decree 1081 of 2015 and the Escazú Agreement.
