Circular No. 000184-4 of the Superintendency of Notary and Registration orders notaries to prevent the authorization of deeds and the registration of rural properties in 82 prioritized municipalities where the owner cannot certify a refusal or administrative silence from the National Land Agency regarding the purchase option established by Decree 033 of 2025. In doing so, the Superintendency transformed a merely informational duty into a substantive enabling requirement without statutory basis; consequently, the challenged act was issued without legal competence, with insufficient reasoning, and in disregard of applicable constitutional and statutory requirements.
