The Constitutional Court admits lawsuit against the clause of the SGP reform that grants the Government exclusive initiative to define the competencies of the Nation and territorial entities
20/03/2026
The Constitutional Court admitted a lawsuit filed by the Foundation for the Rule of Law against a provision of Legislative Act 03 of 2024 which, by changing a single term, grants the national Government the power to define the competencies of the Nation and territorial entities through an organic law of its exclusive initiative. The Foundation's lawsuit does not challenge the increase in transfers to the territories or fiscal decentralization, but rather contests the removal of constitutional protection over the competencies of the Nation, departments, districts, municipalities, and indigenous territorial entities, which would henceforth depend on the Government's will.
