Intervention regarding Legislative Decree 135 of 2025, which adopts budgetary and fiscal measures to support territorial entities

In Judgment C-216 of 2025, the Constitutional Court declared the decree unconstitutional for two reasons: (i) it was not signed by all the ministers in office, as required by Article 214.1 of the Constitution, which constitutes an incurable formal defect; and (ii) unconstitutionality by consequence, since it addressed a procedural matter concerning the restructuring of Ocaña, unrelated to the purposes of the state of internal disturbance.
