Intervention regarding Legislative Decree 131 of 2025, which facilitates the execution of investment projects with resources from the General Royalties System

29/05/2025

In Judgment C-207 of 2025, the Constitutional Court declared the decree unconstitutional for two reasons: (i) unconstitutionality by consequence, since part of its content was based on facts previously struck down in Judgment C-148/25 (unmet basic needs and damage to infrastructure caused by the conflict), which are considered structural rather than supervening problems; and (ii) lack of valid ministerial signatures: the decree was not signed by all the ministers, and two of the signatories lacked legal authority, so an essential formal requirement was not met.
