Intervention regarding Legislative Decree 107 of 2025, which adopts measures to protect agricultural production and guarantee the right to food

In Judgment C-249 of 2025, the Constitutional Court declared the decree unconstitutional for the following reasons: (i) unconstitutionality by consequence with respect to the phrase "or linked to the Comprehensive National Crop Substitution Program"; (ii) failure to meet the tests of purpose, reasoning, connection and necessity, since it sought to resolve structural problems of the agricultural sector that were neither supervening nor imminent; (iii) the absence of technical and budgetary studies supporting several of the measures; and (iv) the existence of sufficient ordinary mechanisms, such as contracting on grounds of manifest urgency under Law 80 of 1993.
