Council of State admits lawsuit against Government energy decree that encroaches on the functions of the CREG

The Council of State admitted a lawsuit seeking the annulment of Decree 1091 of 2025, which enables direct Government intervention in areas reserved by law for independent technical regulation. The Government encroached upon the exclusive competencies of the Energy and Gas Regulation Commission (CREG), thereby affecting its technical independence, the legal certainty of the sector, and market rules. The Council ordered the Government to be served with the request for a precautionary measure of provisional suspension, leaving open the possibility of staying the decree while proceedings advance.
