Annulment action against paragraph 56 of Article 1 of Decree 4886 of 2011, which grants inspection powers to the Superintendency of Industry and Commerce
30/05/2025
Paragraph 56 of Article 1 of Decree 4886 of 2011 empowers the Superintendency of Industry and Commerce (SIC) to conduct inspection visits, which violates the principles of legality and of the reservation of statute, since the regulation of powers inherent to administrative sanctioning proceedings belongs exclusively to the Congress of the Republic. Accordingly, the provision exceeds the regulatory power by creating competences without express legal basis. In addition, the rule compromises fundamental rights such as privacy and due process by allowing invasive actions without a sufficient legal framework. It therefore constitutes an overreach of authority contrary to the legal order.
