Annulment action against Decrees 50 and 2287 of 2023 and other resolutions amending road concession contracts

Decrees 50 and 2287 of 2023, issued by the President of the Republic and the Ministries of Transport and of Finance and Public Credit, and Resolutions 20243404001125, 202434040035675 and 202434040065055 of 2024, issued by the Ministry of Transport, intervened in the economic structure of ongoing concession and public-private partnership (PPP) contracts. The measures unilaterally amended clauses, prohibited CPI-based adjustments, suspended contractual instruments, altered rate formulas and shifted compensation for lower revenues to the General National Budget. The acts exceed the regulatory power, lack competence, violate Law 105 of 1993 and the agreed economic balance, and rest on false grounds.
