Annulment action against Decree 413 of 2025 on the habitability certificate, which exempts structural housing interventions from licensing

Decree 413 of 2025 eliminated the requirement of an urban planning license for housing improvement works financed with public subsidies, without establishing an equivalent alternative system of technical and urban-planning verification. This weakens controls on compliance with earthquake-resistant building codes and allows works without independent review. It also displaces municipal competences related to land-use planning and building control, reducing the role of local authorities to partial and insufficient mechanisms.
