{"id":3081,"date":"2025-10-24T12:28:32","date_gmt":"2025-10-24T17:28:32","guid":{"rendered":"https:\/\/fedecolombia.org\/doc\/council-of-state-orders-the-national-government-to-implement-the-national-early-warning-system-to-prevent-sexual-violence-against-children-and-adolescents\/"},"modified":"2025-10-24T12:28:32","modified_gmt":"2025-10-24T17:28:32","slug":"council-of-state-orders-the-national-government-to-implement-the-national-early-warning-system-to-prevent-sexual-violence-against-children-and-adolescents","status":"publish","type":"doc","link":"https:\/\/fedecolombia.org\/en\/doc\/council-of-state-orders-the-national-government-to-implement-the-national-early-warning-system-to-prevent-sexual-violence-against-children-and-adolescents\/","title":{"rendered":"Council of State orders the national Government to implement the National Early Warning System to prevent sexual violence against children and adolescents"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Bogot\u00e1, 24 de octubre de 2025 (@FEDe_Colombia_). <\/strong>El Consejo de Estado orden\u00f3 poner en marcha el Sistema Nacional de Alertas Tempranas para prevenir la violencia sexual contra ni\u00f1os, ni\u00f1as y adolescentes y mujeres, al confirmar la sentencia del Tribunal Administrativo de Cundinamarca que dio la raz\u00f3n a la acci\u00f3n de cumplimiento interpuesta por la Fundaci\u00f3n para el Estado de Derecho (FEDe. Colombia). En su decisi\u00f3n, el Consejo de Estado se\u00f1al\u00f3 que, durante m\u00e1s de cuatro a\u00f1os, las entidades responsables, entre ellas el Instituto Colombiano de Bienestar Familiar (ICBF), los Ministerios de Justicia, Salud e Igualdad y la Fiscal\u00eda General de la Naci\u00f3n, no han determinado el mecanismo a trav\u00e9s del cual operar\u00e1 y se implementar\u00e1 el sistema, pese a la obligaci\u00f3n establecida en la Ley 2137 de 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Ley, vigente desde agosto de 2021, cre\u00f3 el sistema con el fin de identificar riesgos, emitir alertas y coordinar respuestas r\u00e1pidas frente a casos de violencia sexual. Sin embargo, las autoridades han incumplido los deberes asociados a su implementaci\u00f3n, a pesar de las reiteradas advertencias de la Procuradur\u00eda General de la Naci\u00f3n y al aumento sostenido de casos de violencia sexual contra menores.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En su demanda, FEDe. Colombia solicit\u00f3 el cumplimiento del art\u00edculo 5 de la Ley 2137 de 2021, para que las entidades determinaran el mecanismo mediante el que operar\u00e1 e implementar\u00e1 el sistema y se reglamentar\u00e1n sus funciones, competencias y componentes, con el fin de garantizar los derechos de la ni\u00f1ez y la adolescencia como poblaci\u00f3n de especial protecci\u00f3n constitucional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durante el proceso, se determin\u00f3 que las acciones que han tomado las entidades han sido poco efectivas y no cumplen con el deber legal. &nbsp;El MinJustica inform\u00f3 que el dise\u00f1o del sistema apenas estaba en discusi\u00f3n, el MinIgualdad admiti\u00f3 no haber determinado el mecanismo de operaci\u00f3n del sistema, aunque dice que est\u00e1 estudiando la posibilidad de integrarlo a otro sistema dise\u00f1ado para la prevenci\u00f3n de las violencias basadas en g\u00e9nero, y el ICBF mostr\u00f3 avances en su articulaci\u00f3n y dise\u00f1o, pero aleg\u00f3 la falta de apropiaci\u00f3n presupuestal para su implementaci\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finalmente, la Fiscal\u00eda General de la Naci\u00f3n y el MinSalud alegaron la falta de presupuesto y de competencias directas. Estas respuestas muestran una omisi\u00f3n prolongada y un incumplimiento claro del deber legal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Consejo de Estado concluy\u00f3 que las entidades incumplieron una obligaci\u00f3n establecida por la ley y les orden\u00f3 definir, en un plazo corto, c\u00f3mo funcionar\u00e1 y se implementar\u00e1 el Sistema Nacional de Alertas Tempranas. Tambi\u00e9n pidi\u00f3 al Ministerio de Hacienda garantizar los recursos necesarios para su ejecuci\u00f3n y reglamentaci\u00f3n. El fallo recuerda que las normas de protecci\u00f3n a la ni\u00f1ez no son opcionales y que el Estado no puede justificar su incumplimiento por falta de presupuesto o tr\u00e1mites entre entidades, despu\u00e9s de cuatro a\u00f1os de entrada en vigencia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEsta sentencia es un paso decisivo para que el Estado cumpla con su obligaci\u00f3n constitucional de proteger a los ni\u00f1os, ni\u00f1as y adolescentes frente a la violencia sexual, uno de los cr\u00edmenes m\u00e1s graves y persistentes en Colombia\u201d, afirm\u00f3 Andr\u00e9s Caro, director de FEDe.
