Unconstitutionality of the confidentiality clause on peace-related information

03/10/2024

The Constitutional Court reviewed a provision of the Total Peace Law and found that it is reasonable to maintain confidentiality over the phases of conversations and negotiations with armed groups, but only if such confidentiality conforms to the Constitution and the laws regulating the right of access to information, and if the necessity of such confidentiality is clearly justified. However, the Court declared unconstitutional the part of the provision that allowed the agreements reached with armed actors to be kept confidential, given that such agreements affect all of society and will be reflected in public policies and in the budgetary execution of the ministries.
