Intervention regarding Legislative Decree 116 of 2025, which adopts extraordinary environmental measures to suspend administrative procedures and create expedited procedures

18/06/2025

In Judgment C-267 of 2025, the Constitutional Court declared the measures of the decree unconstitutional, since they had no direct and close connection to the facts underlying the partial upholding of Decree 062 of 2025. In its decision, the Court: (i) noted that Decree 116 addressed structural environmental problems in the Catatumbo region with no immediate relation to the extraordinary public-order situation; and (ii) found that the suspension of environmental procedures, the shortening of administrative deadlines and other measures were structural in nature and did not seek to directly mitigate the effects of the violence or to protect the population.
