Council of State admits lawsuit against a rule allowing the Attorney General’s Office to suspend arrest warrants outright at the national Government’s request

25/09/2026

The rule was issued in 2012, during the Juan Manuel Santos administration, and provides that the Attorney General shall suspend certain arrest warrants for as long as the national Government requests. The debate regained relevance with the Total Peace policy. Although the current Government ended several negotiation tables, the Council of State must determine whether the suspension of a judicial order may be ordered by the Attorney General's Office at the national Government's request or whether it requires the prior and independent assessment of a judge. It is a question that transcends any single administration.
