Annulment action against the setting of the 2026 UPC for false reasoning, methodological irregularities, and non-compliance with constitutional orders

The Foundation for the Rule of Law filed suit before the Council of State seeking the annulment of Resolution 2764 of 2025, which set the per-capita health unit (UPC) for 2026. The Government used incomplete data, disregarded orders of the Constitutional Court, and did not allow meaningful participation by stakeholders in the system. The Foundation also requested an urgent precautionary measure requiring the Ministry of Health to recalculate the 2026 UPC within 30 business days, applying the methodology ordered by the Constitutional Court.
