According to an analysis by the Foundation for the Rule of Law, the earthquake emergency meets the constitutional requirements but entails limits and controls on the government

24/08/2026

After a preliminary analysis, the Foundation for the Rule of Law concluded that Decree 1261 of 2026 meets the constitutional requirements for declaring a state of economic, social and ecological emergency due to a serious public calamity following the August 10 earthquake. The Foundation warned, however, that the decisions the government adopts during the emergency must be directly related to addressing the calamity, be sufficiently justified and be subject to clear controls on the use of public resources.
